View Full Version : Breeder wants dog back!!!!!!!

I adopted a chi from a breeder about a month ago. It was a cash trasaction for a couple dollars. We had no contract just a cash transaction and she gave us the dog. We just recently found out that our chi is pregnant now and about to deliver in two weeks!!!!

We told the breeder this and wanted to get some medical records but she and the vet they saw will not release them to us. She is constantly sending emails saying the puppy is hers because she got pregnant in her care!!! She insists we bring the dog back and let her whelp the dog and then we can have our dog back (over my dead body!!!). She will then give us the pup for a nominal fee of $1000.00!!!

Again, she will not stop emailing and it is driving my wife crazy. I called and thanked her for her concern and told her the communication is over and to move on but unfortunately she does not comprehend the English language and only in it for the money!!!

Does the breeder have a right to the pup or money for it?

Does the vet she used have to give us the records? Currently the vet is refusing since the breeder got involved.

No, the breeder cannot take the dog back.

The vet does not have to give you the records, though.

What an awful situation =/ I would just ignore the breeder, and make sure that you have a good vet for when it is time for her to deliver the puppies.

Jessie is right, you have no obligations to give her the dog back, especially when there were no contracts. I may be wrong, but sounds like she wants the dog back to sell the puppies -- $$$.

This is very irresponsible of the breeder. I would just ignore her e-mails.

The vet will probably not disclose any records to you because those are personal and confidential. At this point, you would have to just seek out a good trustworthy vet to help you through with this.

Hi. The dog is yours. And like Jessie says, you won't get the records, but an with an exam, you will find out what you need. Sorry you have to go through this. Hope she doesn't cause more problems for you, and I hope you can block the breeder from your email, or change it for a while. Welcome to Club Chihuahua too! Barb :)

What a jerk I must say. What is wrong with people these days.
Definately add the breeders email to your block list this way she sees that her emails are being rejected.

I agree she belongs to you she can not insist on you returning her unless you had a writen contract saying you would if the dog was founf to be in pup. Tell her to get lost and in future take bettewr care of her dogs so un expected pregnacies dont happen again. I wish you luck with your Chi and the whelping.

A "handshake deal" is a binding contract. Once you exchanged money-no matter how much money, then the deal is done. If she contacts you again, tell her next time she will hear from your lawyer. This is harrassment from her to you at this point. I wouldn't hesitate to get a lawyer involved if she contacts you again. Sounds like she wants a piece of the pie.

Chichime said it well. If the tables were turned and you were trying to return the doggie for some reason she would be saying that your handshake and small monitary exchange was a contract. I would say that she "sold" you the dog as is and the dog is yours to keep as is including the puppy to come.

Get a lawyer just in case. Welcome to the Club. Let us know what happens.

thanks for all the input. I have found a net vet and a breeder that has been breeding and showing dogs for 15 years to help with the process. I just hope everything goes OK now. We got one last emial from the breeder and then that was it after we told her we were contacting the IRS and kennel association on her if she did not cease the communication immediately. Might just do this anyway after this whole whelping process is over.

What size is your chi and you need to do a xray or ultra sound because you do not know the size of the male if he was bigger than her she could have problems. You need to find a vet that is on call for the middle of the night just in case she needs a emergency csection and be prepared I hve one on standby right now and my female is due in 1 1/2 months but regular price for a c-section is 200-500 dollers and 500-800 for an emergency so check this out asap

Good advice, my girl is only 4 weeks at the mo but I have my vet on call just in case, coz you never know.

I agree with everyone. You may need a lawyer, as Faye mentioned. IN COURT your verbal contract would be considered binding and lawful (that one business law class actually taught me something!). If it did come to that, maybe the court could order the paperwork, not sure. IF it comes to that, and hopefully it won't!! Prayers for you all!

So what happened on this deal? I hate people like that. Shes in it for monetary reward and not the love of the pup-she so willingly gave away. I have a soft heart for animals but I would love to pay a visit to this womans husband and solve this little problem. :evil:


BTW hi everyone again!

Offnote: The other day I was tossing some treats to Chi and Layne (Buddies rat terrier). Layne was so excited he accidentally gobbled a small Chi turd that was about the same size and color as the treat. He was not very happy.

I wonder how it turned out. I'm not sure a hand shake is a legal binding contract, and if a hand shake is only good faith, or if that counts legally? It may have to be in writing?
